According to a report from the IndyStar, Jennifer Ruby, the state’s Public Access Counselor (PAC), appointed by Governor Mike Braun is taking 250 days on average to issue opinions regarding complaints filed with their office.

That far exceeds the 30 day requirement set by state law, and three times longer than the average set by Luke Britt, the previous PAC during his final two years in office.

While the opinion’s issued by the Public Access Counselor are meant to advise public officials, they are routinely followed, and provide Indiana residents a cheaper alternative to filing a lawsuit.

The report also revealed that during Britt’s tenure he found that the government was in violation in two-thirds of his opinions, while Ruby is the opposite siding with the government in two-thirds of her cases.

Braun is quoted as announcing prior to Ruby’s appointment that, “Transparency for Hoosiers is important for a healthy state government, and Jennifer Ruby brings decades of legal expertise to serve Hoosiers as Public Access Counselor. She will do a great job promoting public trust through transparency and accountability.”

The article also includes several examples of complaints that were filed, including one from Maria Flora. editor of the Lebanon Reporter, who questioned a contract that was signed by Boone County Commissioners outside of a formal meeting.

It took Ruby’s office 314 days to respond to the complaint, and her opinion sided with the commissioners. Flora admitted by the time she received the response barely mattered, echoing the sentiment expressed by many residents that, “justice delayed is justice denied.”
